The Hon'ble Supreme Court has affirmed that the maximum time limit granted under the Code w.r.t. Commercial suits is 'mandatory' in nature, unlike in case of Ordinary suits where the provisions of Order VIII Rule 1 have been held to be 'directory' only [Shoraj Singh vs. Charan Singh, CA 6304/ 2021] [ Commercial Law, Contract law ]
