The Hon'ble High Court of Delhi in its judgement of Stroh Breweries' case has held that all commercial contracts are terminable in nature, even if the Contract is either silent about it or makes it non- terminable. However, it will appropriate for the Court or the Arbitrator to look into the aspect of rightfulness or the wrongfulness of the 'termination'.
The Hon'ble Supreme Court has affirmed that the maximum time limit granted under the Code w.r.t. Commercial suits is 'mandatory' in nature, unlike in case of Ordinary suits where the provisions of Order VIII Rule 1 have been held to be 'directory' only [Shoraj Singh vs. Charan Singh, CA 6304/ 2021]
