Commercial Contracts are terminable in nature: Delhi high Court (2000)
The Hon'ble High Court of Delhi in its judgement of Stroh Breweries' case has held that all commercial contracts are terminable in nature, even if the Contract is either silent about it or makes it non- terminable. However, it will appropriate for the Court or the Arbitrator to look into the aspect of rightfulness or the wrongfulness of the 'termination'. [ Commercial Law, breach of contract ]
Time limit for filing written statement under the Commercial Courts Act is mandatory: Supreme Court
The Hon'ble Supreme Court has affirmed that the maximum time limit granted under the Code w.r.t.
